User Accounts

  • This license terminates when you delete your content or account

Subscriptions and Payments

Subscription Terms

  • Some features may require a paid subscription
  • Subscriptions are billed through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

Free Trials

  • Free trials, if offered, allow you to try the Service before committing to a subscription
  • You may cancel before the trial period ends to avoid charges
  • If you do not cancel, you will be charged the subscription fee

Refunds

  • All purchases are processed through Apple’s payment systems
  • Refund requests are subject to Apple’s refund policies

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYMORPHICAL SHALL NOT BE LIABLE FOR:

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Polymorphical, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service

  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

Data Backup

You are solely responsible for backing up any data you create or store through our applications. We are not responsible for any loss of data.

Updates and Modifications

Apple-Specific Terms

Acknowledgment

You acknowledge that these Terms are between you and Polymorphical only, not with Apple, and Apple is not responsible for the Service or its content.

Scope of License

The license granted is limited to a non-transferable license to use the application on Apple devices that you own or control.

Maintenance and Support

Polymorphical is solely responsible for providing maintenance and support services. Apple has no obligation to furnish any maintenance or support.

Warranty

In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.

Product Claims

Polymorphical is responsible for addressing any claims relating to the application or your use of it, including:

  • Product liability claims
  • Claims that the application fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar legislation

Intellectual Property Rights

In the event of a third-party claim that the application infringes intellectual property rights, Polymorphical, not Apple, will be responsible for investigation and defense.

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

By using our applications, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
